Development Advisory
We assist some of the leading commercial real estate agencies in Melbourne in preparing information memorandums for the sale of complex sites or sites with significant development potential. For these projects we often work collaboratively with leading architectural practices in the preparation of concept schemes which assist prospective purchasers in identifying the development potential of the site.

Consideration of internal amenity has become more prevalent in planning decisions for residential apartment projects assessed by Councils and VCAT over the last two years with the State government currently preparing a draft apartment code. A recent VCAT decision accessible here (http://www.austlii.edu.au/au/cases/vic/VCAT/2016/373.html) has considered what the ‘best practice’ ESD approach is to assessing daylight access into a residential development. This decision follows the recent (late 2015) introduction of new ESD policies into a number of inner and middle suburban Council planning schemes.
The Tribunal found that the best practice approach outlined in ESD tools such as BESS should be followed where practicable, giving further weight to the use of such tools as BESS and Green Star when assessing the amenity offered by proposed development. Clearly ESD considerations are becoming more and more part of the planning stage of new development rather than left to the building permit stage.
